AudilyNow Privacy Policy

1. What this policy covers

AudilyNow (“we”, “us”, “our”) is a custom-AI-song service. You provide a creative brief, we generate a song using AI, and you pay $10 to receive the delivered MP3 and a shareable page. This policy describes the personal data we collect, why, how we use it, who we share it with, how long we keep it, and what rights you have over it.

It does not apply to third-party services we link to or integrate with (e.g. Stripe), which have their own privacy policies (see Section 5).

2. What personal data we collect, and why

We do not collect government IDs, social security numbers, financial account numbers, health information, location data, or biometric data at registration.

2.3 Automatic data

When you use AudilyNow, our servers automatically log your IP address (for security and abuse prevention; truncated/hashed after 30 days), user-agent string, authentication events, and order state transitions.

2.4 Cookies

The web client uses minimal cookies — only a session token. We do not use third-party analytics tags, advertising trackers, or ad cookies, and we do not sell or share personal information with advertisers.

2.5 What we DO NOT collect

  • Voice samples / voice biometrics: uploading your own voice for AI cloning is not part of AudilyNow today. If we ever introduce this, it will require separate, explicit consent and an updated policy.
  • Children’s data: we do not knowingly collect data from anyone under 13 (see Section 8).

3. How we use your data

  • To create and deliver the songs you order.
  • To process payments through Stripe.
  • To send transactional emails (verification, receipts, refund confirmations, password resets).
  • To prevent fraud, abuse, and security incidents.
  • To respond to support requests and exercise your rights (Section 7).
  • To comply with our legal obligations (tax records, regulatory inquiries).

We do not use your personal data for behavioral advertising, for selling or sharing with third parties for their own marketing, or for automated decision-making with legal effects.

4. How long we keep your data

5. Who we share your data with (sub-processors)

We do not sell, lease, or trade your personal data, in any meaning of those terms under CCPA/CPRA, GDPR, or any similar law.

6. International data transfers

Our servers are located in [region — to be finalized]. If you are in a jurisdiction with cross-border transfer restrictions, your data is transferred and processed under an appropriate safeguard (e.g. Standard Contractual Clauses).

7. Your rights

Depending on your jurisdiction, you have some or all of the following rights: access, rectification, erasure (“right to be forgotten”), portability, restriction, objection, opt-out of sale/sharing (we do not sell or share for advertising), limiting use of sensitive data, and non-discrimination for exercising any of these rights.

To exercise any right, email us. We will respond within the legally required window (30 days under GDPR, 45 under CCPA). We may verify your identity before fulfilling a request.

8. Children’s privacy

AudilyNow does not knowingly collect personal data from anyone under 13. At registration we ask for date of birth and reject any user whose calculated age is below 13. If we discover we have collected data from a child under 13, we will delete it without undue delay. Parents or guardians who believe their child has provided personal data may contact us.

9. Security

We protect your personal data with TLS encryption for all API traffic, strong password hashing (never stored or transmitted in plaintext), encryption at rest for the production database, limited access controls, and audit logging. No system is 100% secure; if a security incident affects your personal data, we will notify you and the relevant authority within the legally required windows.

10. Changes to this policy

We may update this policy as the service evolves. Material changes will be announced by email and via an in-app banner at least 14 days before they take effect.
